This official report has been read and examined thoroughly. When its content has been taken into consideration, it is seen that it is by no means the intention of the administrative council of Gaza to abide by the regulations, that the report is unnecessarily long and includes nothing worthwhile to examine. However, it is seen that, the criterion concerning the land that will be converted into a square is designated as the width and not the length, and as it has been stated by this report, the given land’s width is approximately 10-20 yards. According to the provisions of the 1st article of Building Regulation, the width of the roads requires to be between 8-20 yards. Under these circumstances, it is normal for the abovementioned location to be considered as a road. Even if it was converted into a square, the municipal council bans the setting of looms, trays and tents to sell commodities and provisions in this location. According to the provisions of the 5th article of the Building Regulation, in such locations the authority of the municipal councils is limited to allowing draught animals and carts. Additionally, it is under no conditions whatsoever legal to convert locations destined for public use, such as courtyards of worship places, piers, public squares and recreation areas. The covering of this location by the municipal council by tents to rent it for selling cloths and provisions would be to convert this location. Thus, it is appropriate to refer to the Sanjak Administrative Council for the consideration of this matter and the execution of necessary measures.
