Upon the Police Department’s letter dated 24 May 1909 and numbered 123, regarding the municipal punishment of the tavern keeper named İstafan due to opposing the Police’s warnings. In the 43. article of the Municipal Councils Regulation, it is clearly stated that the perpetrators of the crimes, pertaining to municipal affairs, specified in the third article of the Penal Code, and those acting in defiance of the general warnings issued by the municipality, shall be put under investigation and duly punished. The Municipal Councils Regulation does not include any certainty with regard to the procedures specified in this report and the opposition by the said tavern keeper is a question of public security and order. Hence, if there is now a legal provision requiring the municipality to punish such acts, it is appropriate to relegate the matter to the Office of the Chief Police Inspector for making an explanation about the issue.
