Upon the petition dated 10 October 1908, presented by Hüseynizâde Abdüsselâm Effendi, Muhammed Said Caûnî and Abdullah Muhammed Ebu Akir (?) regarding their lands located outside Jaffa Gate around the ditch and annexed to the road
This petition has been scrutinized by our council. Upon the imperial decree issued before the Jerusalem trip of the German Emperor, his Majesty, in 1898-1899, it was made obligatory to dispense and open the road across the ditch inside and outside Jaffa Gate. Hence, 20 wooden stores within Jaffa Gate belonging to the municipality, the salt silo belonging to the Public Debts Administration, and the land belonging to the petitioners, which was situated in front of the road outside Jaffa Gate going to the kaza of Bethlehem and whose surface area is made up of 700 archine square, was taken and annexed to the road. Upon the petition erstwhile presented by the owners, an inspection was made, in accordance with the Real Estate Confiscation Law, by relevant people about paying the cost of the said land from the municipal fund and each archine of this land was estimated to be 1 French lira. In the decision taken as regards this matter by the Sanjak Administrative Council on 7 April 1899, it was explained that 700 French liras, which is the cost of the said land, be covered from the municipal fund. However, the municipal fund’s incomes are insufficient; thus, with regards to the method of payment of the said money, a marginal note has been written on the document and relegated to the Sanjak Administrative Council. It is now requested that the said land be returned to them or a place from the municipal real estates be given to them in exchange. However, it would not be possible to give the said land as it has already been annexed to the road and the municipal incomes are not sufficient to compensate it; hence, for negotiating and explaining the necessary course of action, it is appropriate to relegate the matter to the Sanjak Administrative Council.
